Seizures and Confiscations

  A law enforcement officer may seize cars or trucks that were used to commit certain drunk driving offenses. Vehicles, money and even houses can be confiscated as part of many drug charges.

Besides that in charges of deer shining, illegal transportation of game or fish and certain other conservation offenses a game warden may seize trucks, cars, trailers, boats, firearms and other hunting or fishing gear.

The property seized often can become property of the law enforcement organization that took it so the policeman or game warden who took it often has a huge incentive to try to keep it. Depending on the kind of seizure, the owner of the property or the law enforcement agency must begin a court proceeding to determine ownership of the disputed property.

At trial, the issues are whether the property was used in violation of the law whether the claimant knew or had reason to know that the property was intended to be used illegally. Confiscations are serious and complex proceedings for which the property owner should seek qualified legal counsel promptly.
